These Terms and Conditions (“Terms”) govern your access to and use of the websites, forms, content, and lead-generation services provided by Pure Home Connections (“we,” “us,” or “our”), a Michigan-based company that connects homeowners throughout Michigan, including the Grand Rapids metropolitan area and the Lower Peninsula, with independent home-improvement and home-service professionals.

By accessing our website, submitting a form or inquiry, or using our services, you agree to be bound by these Terms and our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, do not use the website or submit any information.

1. Description of Services

Pure Home Connections operates an online lead-generation platform and marketing service. Homeowners submit inquiries through our website or advertisements regarding home-improvement and home-service needs. We qualify leads using the information provided and share them, on an exclusive or shared basis, with independent, vetted home-service professionals and contractors in Michigan who have contracted with us.

Important Disclaimers

• We are not a contractor, home-service provider, or direct service provider. We do not perform home-improvement work, provide warranties on services, or act as an agent for any contractor.
• We do not guarantee that you will receive contact from partners or guarantee the speed or quality of responses, pricing, licensing status of any partner, or results from any service.
• Matches are based on the information you provide and partner interest and availability. We screen partners to the best of our ability but make no warranties regarding them.
• You deal directly with any partner you choose. The partner’s terms, privacy policy, and practices apply to that relationship.
• All home-improvement and home services involve risks. Perform your own due diligence, obtain multiple quotes, and consult licensed professionals as needed.

2. User Obligations and Representations

You represent and warrant that:

• You are at least 18 years old and have the legal capacity to agree to these Terms.
• All information you provide is accurate, complete, and current.
• You have the right and authority to submit information about the property or inquiry.
• You will not use the site or services for any illegal purpose, to spam or harass others, to violate another person’s rights, or in any manner that could harm us or our partners.
• You will comply with all applicable laws.

You are solely responsible for the information you submit and any resulting consequences.

3. Consent to Communications and TCPA Compliance

By providing your phone number, including a mobile number, and/or email address and submitting a form or inquiry, or by affirmatively checking a consent box, you expressly provide your prior express written consent, including an electronic signature through the checkbox or submission action, for Pure Home Connections and its vetted partner home-improvement and home-service professionals in Michigan to contact you at the telephone number(s) and email address(es) you provided.

Communications may include live telephone calls, text messages (SMS/MMS), emails, automated dialing systems (ATDS), artificial or prerecorded voice messages, and other communications regarding your specific inquiry about home-improvement or home services in Michigan. This consent applies even if your number is listed on the National Do Not Call Registry, a state Do Not Call list, including Michigan’s, or an internal do-not-call list.

Key TCPA and Compliance Disclosures

• Consent is voluntary and not a condition of purchasing goods or services or receiving any benefit.
• The purpose of the contact will be logically and topically related to your inquiry regarding home-improvement or home-service needs in Michigan.
• Message and data rates may apply to calls and text messages.
• You may revoke your consent at any time through any reasonable method, including replying “STOP” to text messages, calling the number provided, or contacting us.
• We and our partners will honor opt-out requests and maintain appropriate suppression lists. Michigan telemarketers generally honor Do Not Call requests and update their lists every 30 days.

We contractually require partners to comply with the TCPA and CAN-SPAM Act, contact consumers only for the consented purpose, and honor all opt-out requests and limits on the scope of consent. Once a lead is shared, the partner is responsible for its own ongoing compliance.

Form consent language on our site will be clear, conspicuous, separate from other terms, and accompanied by a checkbox that is unchecked by default.

4. Prohibited Uses

You may not:

• Scrape, crawl, or harvest data from the site.
• Use automated means to submit forms or create false inquiries.
• Interfere with the site’s operation or security.
• Impersonate another person or provide false information.
• Use the services in violation of any law, including the TCPA or applicable advertising rules, or in a manner that harms others.
• Reverse engineer or copy site content or technology without permission.

We reserve the right to suspend or terminate access for violations.

5. Intellectual Property

All content on the site, including text, graphics, logos, images, software, the “Pure Home Connections” name and branding, and Michigan-themed elements where used, is owned by us or our licensors and is protected by copyright, trademark, and other applicable laws. You may not use, reproduce, modify, or distribute this content without our prior written permission, except for personal, noncommercial use of the services as intended.

6. Disclaimers and Limitation of Liability

The services and site are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, or uninterrupted or error-free operation. We do not warrant that leads will be high quality, that partners will respond, or that any particular result will occur.

To the maximum extent permitted by Michigan and federal law:

• Our total liability to you for any claim arising out of or related to the site or services is limited to the greater of: (a) the amount you paid us, which is typically $0 for homeowner users; or (b) $100.
• We are not liable for indirect, incidental, consequential, special, punitive, or exemplary damages, including lost profits, data loss, or business interruption, even if we have been advised of the possibility of such damages.
• These limitations apply regardless of the theory of liability, including contract, tort, or strict liability.

Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.

7. Indemnification

You agree to indemnify, defend, and hold harmless Pure Home Connections and its officers, employees, agents, partners, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your use of the site or services, information you provide, your violation of these Terms or any law, or your interactions with partners.

8. Governing Law, Disputes, and Arbitration

These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-law principles.

Any dispute arising out of or relating to these Terms, the Privacy Policy, or the services shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will be held in Grand Rapids, Michigan, or another mutually agreed location. The arbitrator’s decision will be final and binding. You waive any right to a jury trial or to participate in a class action or representative proceeding.

Exception: Either party may seek injunctive or other equitable relief in a court of competent jurisdiction for intellectual-property or breach-of-confidentiality claims. Small-claims court actions are also permitted where eligible.

You may opt out of arbitration by sending written notice to the address listed in Section 11 within 30 days after first agreeing to these Terms.

The courts of Kent County, Michigan, and the U.S. District Court for the Western District of Michigan will have exclusive jurisdiction over any matter that is not subject to arbitration.

9. Termination

We may terminate or suspend your access to the site or services at any time, with or without notice, for any reason, including a violation of these Terms. Provisions that by their nature should survive termination, including disclaimers, liability limitations, indemnification, governing law, and intellectual-property provisions, will remain in effect.

10. Miscellaneous

• Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement between you and us regarding the subject matter and supersede all prior agreements.
• Severability: If any provision is found unenforceable, the remaining provisions will remain in effect.
• Waiver: Our failure to enforce any right does not constitute a waiver of that right.
• Assignment: You may not assign these Terms without our consent. We may assign them freely.
• Changes: We may update these Terms at any time. Material changes will be posted with a new effective date. Your continued use of the site after changes are posted constitutes acceptance of the updated Terms.
• Notices: We may provide notices through the site, by email, or through other reasonable means.
